Claim: Senator Vicente “Tito” Sotto said only 11 votes are needed to convict Vice President Sara Duterte in her impeachment trial.

Why we fact-checked this: Multiple posts bearing the claim were uploaded on June 3, in the Facebook group “SARA DUTERTE SUPPORTERS,” which has over 487,400 members. 

The posts featured a manipulated quote card of Sotto supposedly saying, “Hindi na namin kailangan ng 16 votes para ma-impeach si Sara, 11 votes po ay sapat na.”

(We don’t need 16 votes to impeach Sara, 11 votes are enough.)

One post has garnered over 390 reactions, 360 comments, and 25 shares, while another received over 70 reactions, 100 comments, and 1 share.

The facts: There are no official statements, interviews, or credible media reports indicating that Sotto ever claimed 11 votes would be enough to convict Duterte in her impeachment trial.

Under Article XI, Section 3(6) of the 1987 Philippine Constitution, a two-thirds concurrence of all members of the Senate is required to convict an impeached official. With 24 senators, this would mean 16 votes must be secured.

Then-Senate President Pro Tempore Sherwin Gatchalian, a close political ally of Sotto, said in a June 10 statement that the baseline requirement should remain fixed at 16. 

“It will remain 16 votes regardless of how many senators attend the trial, which bloc controls the chamber, or who presides over the impeachment court,” Gatchalian said.

Challenging the threshold: However, emerging views from some practitioners of the law are challenging the 16-vote threshold, pointing out that the absence of several sitting senators — Senator Jinggoy Estrada, who is detained for his non-bailable plunder and graft cases, and Senator Ronald “Bato” Dela Rosa, who is currently in hiding — means the conviction threshold should be lowered.

Other senators are also facing or could face plunder charges soon, namely senators Rodante Marcoleta, Joel Villanueva, and Chiz Escudero.

For House lead prosecutor Jinky Luistro, the conviction threshold should depend on the actual number of senator-judges participating in the trial.

“If you can attend, if you can participate, if you can vote, then you are representing the interests of the Filipino people. But if you are beyond the reach of any coercive measures, and you did not attend, and you did not vote, why should you be counted for the purpose of determining the number of votes required?” Luistro said.

In a scenario of only 21 or 22 Senate members, the argument is that 14 or 15 votes would be required for conviction. (WATCH: Are 14 votes enough to convict VP Sara Duterte?) 

Sara’s impeachment: Duterte became the first Philippine official to be impeached twice after 257 lawmakers voted to impeach her on May 11, 2026. (LIST: The 4 articles of impeachment vs VP Sara Duterte).

She is accused of culpable violation of the Constitution, graft and corruption, and betrayal of public trust, largely due to alleged irregularities in the use of her office’s confidential funds.

The Senate is set to begin Duterte’s impeachment trial on July 6.
